Terms of Use

If you would like to use any of the graphics you find on this site (Smile-Recipe.net) you must agree to and follow these 'Terms of Use'. Please keep in mind these terms grant you a specific "use" license as defined below, but the original graphics remain my original, copyrighted property.

These "Terms of Use" are enforcable whether you have read them or not, and are considered a legally binding agreement.

Please respect the time and effort I put into these creations by following these terms. These terms are in place to not only protect myself and my own work, but to also protect those individuals who purchase a "use license" for any of my graphics.

Please be aware that I will not hesitate to contact you, your ISP (Internet Service Provider) or take other actions if I discover these terms are not being followed.


1. Commercial Use
    You may not sell any graphic, or element from any graphic on this site for financial gain including commercial purposes.

2. Redistribution
    You may not redistribute any graphic or element from any graphic on this site for any other purpose than those specified. Graphics are intended for PERSONAL USE ONLY, and are not to be included in any compilations, membership offerings, etc. This includes "adoption" sites.

    If you think someone other than yourself would like to use an image from this site, please direct them here.

3. Edits and Customization
    You may not alter, edit or modify any graphic or element from any graphic on this site. Additionally, you may not use any graphic or element from any graphic on this site for the creation of "tubes" or "outlines".

      a. Websets - You MAY add text to elements provided as part of a "web set" (ie. buttons)

      b. Materials - You may used background "fills" or tiles to create matching elements for YOUR website only and proper credit with a link must be given when using backgrounds or tiles in this manner)

      c. Signatures - if specified, you MAY add a border, frame or other "bounding" element to a signature for the purposes of incorporating it into YOUR website or theme where the signature is displayed. You may not, however, alter the main elements of the signature or graphic in any way.
4. 'Makers'
    You may not use any graphic or element from any graphic on this site as part of any type of graphic "maker" (dollmaker, roommaker, scenemaker, etc.)

5. Right to Access
    If you use my graphic(s) on a site that requires a login to access the page where the image is diplayed, you will need to provide me with a guest login/password to your site.

6. Use for Print
    You may not use any graphic or element from any graphic on this site for printed work (cards, t-shirts, craft projects, etc.)

7. How to Credit
    Proper credit must be given wherever my images are used.

      Purchaseware - you are not required to place a link back to this site for purchaseware, however you must clearly indicate that I am the original author/creator of the image no matter where/how it is used.

      Example: Copyright 2007, Katie Bailey, Smile-Recipe.net.

      This can be in the form of text and/or a hover or image "alt" tag.

      Linkware - you MUST provide proper credit AND include a link back to http://www.smile-recipe.net/ wherever my linkware image(s) is/are displayed/used. This includes any forums, mailing lists and email.

      "Freebies" - you are not required to place a link back to this site for Freebies, however proper credit must still be clearly indicated in the form of text and/or hover tags wherever the image is used/displayed. All other terms apply as well.

8. Terms for Ordering
    When ordering, you MUST provide a valid email address, and if you intend to display my images on a personal web page or blog you must provide a valid, URL. (See Term 5 for those sites requiring login/password to access)

    Please DO NOT place an order unless you intend to complete the order. If you create an order, in particular those with customizations, and then do not respond to the PayPal request or attempts to contact you, I may report the incident to PayPal and/or your Internet Service Providor as potential "fraud".

    If some exceptional circumstance occurs after submitting an order (I realize things do come up for people and I'm not an unreasonable person), please be courteous and contact me to indicate you would like to cancel or otherwise adjust your order.
